In such cases it is advisable that a personal dialogue be established with the tenant and differences sorted out on a personal level by making subtle changes mutually agreeable to both. A phone call reminding the tenant about a delayed payment or a personal visit may solve the issue in most situations.

If the problem still persists with the tenant making a deliberate attempt to default then you should proceed with legal regulations. Normally such proceeds should start with a notice which should clearly mention terms and conditions as laid out in the agreement and action that shall be initiated in case of non response to the notice. If still there is no response or no payment then as a last resort the landlord is within his rights to go ahead with eviction proceedings.

If problems still continue then you need to send a notice which basically serves as a reminder to pay the outstanding rent. In case you do not receive any reply to the notice or payments connected it is most likely that you might have to initiate eviction proceedings. It is in the interest of all concerned to avoid a legal confrontation as these prove extremely expensive and a long drawn out affair. Most tenants opt to settle the dispute out of court and if this option is not exercised by the tenant then the legal procedures will have to be completed and decision awaited. Once a decision to evict the tenant is made by the honorable court then the landlord can ready the premises to give out for rent again this time to a more capable tenant.
